you cannot sue a stranger on the street for sexual harassment because you have no relationship with him at all. Konggirl always have a false impression that they can sue anyone on street, on bus, on MTR, etc, sorry but this is wrong
even if you fall within the specified relationships allowed by the Ordinance, whether foul language can constitute act of sexual harassment is also a question. In the case of 鄭燕芳 v. 屯門安定邨街市報攤 (HCA 5975/1999), Judge W.Yeung said:
"報攤有男子採用涉及兩性不道德性行為的粗言穢語。本席不能忽視在中國人社會,特別是廣東人社會,某階層人士在交談或爭吵時採用粗言穢語,包括男女生殖器官之粗俗稱謂,是十分普遍。本席並不是鼓勵他人採用粗言穢語,但本席須認知社會上某階層的人士,採用粗言穢語是非常普遍的行為。這種行為並不一定構成性騷擾"
"當然以粗言穢語辱駡一名女子,在任何情況下都屬無禮貌,不是君子行為,該等行為亦會令原告感到受冒犯,侮辱或威嚇。該等行為均屬粗魯行為,但並不構成性要求或涉及性的行徑,故亦不能稱之為性騷擾。" |
